Mediation? That will never work!
When mediation was in its infancy in North Carolina, I was practicing law in one of the counties that had a pilot program. My first experience with mediation led me to say that it would never work! Wow, if I had only known how wrong I was at the time.
Mediator cannot write your agreement.
A Mediator cannot write up an agreement or a Consent Order for the parties. Most unrepresented parties go to mediation for the purposes of avoiding lawyers and/or avoiding court.
Husband and Wife decide that they no longer wish to be married and are going to separate. Both parties agree they do not wish to have their private affairs resolved in the court by someone that they may see in social circles or in front of people that they do not know.
How to be ready for your Mediation.
Everyone who either voluntarily participates in a mediation or who participates in a court-ordered mediation should take the time to prepare. If you are going to have to be there anyway you should try to at least get the most out of the experience. Sometimes mediations are successful in resolving all or part of a dispute or a court case.

The single best tool or asset you can have at any mediation to give you the best chance of success is a calm, open mind.
